Recommendations from SG/SC/JB with advice from HP
1. Contact details: Landlord's address and tenant's details need amending.
2. Interest payment: interest at 4% will be levied on delayed rental payments
3. Plan: CTC now has a plan of the building but has not been given to the solicitor as yet to edge red as described in the lease. CIC wants to also include the paved area overlooking the cricket square. Recommend approval.
4. Rent: Recommend no security deposit.
Rent: Recommend paid monthly from the date of signing of the lease.
Term of lease: Recommend 10 years as requested.
Review: Not a good idea to be tied. Start low to kick start after Covid but needs to be an annual rent review for next 1-2 years. Thereafter every 2-3 years.
Amount: In first instance rent to be based on annual expenditure of CTC for clubhouse ie insurance/CCTV/maintenance costs. Thereafter to be based on market rate as advised by surveyor approved by both parties. Suggested nominal rent for first year £2100pa = £175 per month
5. Access: If anyone outside CIC needs access, needs to be accompanied by a member of CIC
6. Responsibilities:
Landlord: To be responsible for the fabric of the building to include doors; windows; boiler including servicing; plumbing infrastructure ie pipes,sinks, toilets and radiators; electrical infrastructure ie consumer unit, wiring, sockets and switches including electrical test.
Tenant: To be responsible for repair/replacement of any damage/misuse. Also general wear and tear and blockages of sanitary ware. Also responsible for PAT testing of all electrical equipment in use within the clubhouse and the alarm system.
7. Aerials/signage: The clubhouse still remains in the ownership of CTC therefore any changes ie signage/aerials need permission from owner to erect. Any signage must have council logo on.
8. Store: Storage of bottled gas for cellar use is allowed but needs to be risk assessed. No dangerous or inflammable materials to be stored.
9. Exterior: Installation of exterior lighting; shade/awning*. Need permission from owner to erect. *Needs to be covered by CIC insurance.
10. Underletting: In my view hiring out by the hour is not underletting (HP)
11. Overdue rent: As rent is monthly, 14 days is reasonable
12. Alarm system: Responsibility of CIC
Additional observations:
Do three council representatives need to be on the CIC board or any council reps at all on the committee given that it is a separate entity from CTC? Members may still remain if they wish but that will be in their personal capacity not as CTC reps.
CIC document: not seen by council. Need a copy on file. To include constitution and accounts.
